Your Rights

Under the UK General Data Protection Regulation (GDPR), individuals have several important rights regarding the personal data that organizations collect about them. These rights are designed to give individuals greater control over their data. Here’s a detailed breakdown of the rights under the UK GDPR:

1. The Right to Be Informed

This is the right to be informed about how your personal data is collected, used, stored, and shared. Organizations must provide clear, accessible privacy policies (like the one we just created) that explain how personal data will be processed.

2. The Right of Access

You have the right to request a copy of the personal data that an organisation holds about you. This is known as a Subject Access Request (SAR). The organisation must provide this information free of charge and within one month of receiving the request.

3. The Right to Rectification

If the information held about you is incorrect or incomplete, you have the right to ask for it to be corrected or updated. Organisations must respond to rectification requests promptly.

4. The Right to Erasure (Right to Be Forgotten)

You can ask for your personal data to be deleted or erased in certain circumstances. For example, if your data is no longer necessary for the purposes for which it was collected, or if you withdraw consent on which the processing is based and there is no other legal ground for processing.

This right is not absolute and applies only in specific situations, such as:

  • The data is no longer necessary for the purpose it was collected.

  • You withdraw consent, and there is no other legal ground for processing.

  • The data was unlawfully processed.

5. The Right to Restrict Processing

You can ask an organisation to restrict or stop processing your data in certain situations. This means the organisation can still store your data, but they can’t use it further unless you agree or there is a legal obligation.

This right applies in situations such as:

  • You contest the accuracy of your data.

  • You object to the processing, and the organisation is assessing whether their legitimate grounds override yours.

6. The Right to Data Portability

You have the right to request your personal data in a structured, commonly used, and machine-readable format. This makes it easier for you to transfer your data from one service provider to another.

This right applies to data you have provided to the organization, and the processing must be based on consent or contract.

7. The Right to Object

You can object to the processing of your personal data in certain circumstances, including:

  • Direct marketing: If an organisation is using your data for direct marketing purposes, you can object to this at any time.

  • Legitimate interests or public task: If the processing is based on legitimate interests or public task, you can object unless the organisation can demonstrate compelling legitimate grounds that override your interests.

8. The Right Not to Be Subject to Automated Decision-Making (Including Profiling)

You have the right not to be subject to decisions based solely on automated processing, including profiling, that significantly affect you. For example, if an algorithm is used to determine something important (like eligibility for a grant), you can ask for human intervention or a review of the decision.

9. The Right to Withdraw Consent

If the processing of your personal data is based on your consent (e.g., subscribing to newsletters), you can withdraw that consent at any time. Withdrawing consent does not affect the lawfulness of processing based on consent before it was withdrawn.

If you wish to exercise these rights or have any concerns about your data, please contact us at info@withloveemma.com.
